«الاستثمار» تكتفي بالتسجيل العيني للعقار لراغبي التملك خارج النطاق الجغرافي – أخبار السعودية

كشفت تحديثات دليل المستثمر، الصادر عن وزارة الاستثمار (اطلعت «عكاظ» عليه)، تخفيف مستندات الخدمة على الشركات الاستثمارية الراغبة في التملك (خارج النطاق الجغرافي)، إذ سيكتفى بتقديم (التسجيل العيني للعقار) فقط، فيما كان يطلب سابقاً (صورة من رخصة البلدية بالبناء أو خطاب موافقة من البلدية، أو ما يوضح نوع استخدام الأرض المراد تملكها صادر عن جهة رسمية، إضافة إلى صورة الصك المراد تملكه).

وتخص هذه الخدمة المنشآت الاستثمارية المسجلة لدى وزارة الاستثمار الراغبة في الحصول على قرار موافقة تملك العقار اللازم لها لممارسة أنشطتها الاقتصادية المسجلة خارج النطاق الجغرافي لغرض «إسكان العاملين، ممارسة الأنشطة»، إذ تستغرق هذه الخدمة 5 أيام عمل فقط، وأن توافق الغرض من التملك مع النشاط الاقتصادي المسجل للمنشأة.

وفي ما يخص تسجيل المنشآت للاستثمار في السعودية وفقاً لنظام الاستثمار ولائحته التنفيذية، أضاف الدليل متطلب (صورة السجل التجاري للشريك الأجنبي مصادقة من السفارة السعودية، مع إرفاق نسخة من سجل الشركة الأم مالكة السجل التجاري للشركة المتقدمة في حال اختلاف جنسية الشركة الأم عن الشركة المتقدمة).

وأبقت الوزارة بقية الطلبات السابقة دون تغيير، وتشمل (صورة السجل التجاري للمنشأة الأجنبية المشاركة مصدقة من السفارة السعودية، وصورة الهوية إذا كان أحد الشركاء فرداً خليجياً «بياناته غير مسجلة في نظام أبشر»، والقوائم المالية لآخر سنة مالية للشركة الأجنبية مصادقاً عليها من السفارة السعودية)، مع إعفاء حاملي الإقامة المميزة من المتطلبات.

The updates to the Investor Guide, issued by the Ministry of Investment (which “Okaz” has reviewed), revealed a reduction in the documentation required for investment companies wishing to own property (outside the geographical scope). Only the (land registration certificate) will be required, whereas previously it was necessary to provide (a copy of the municipal building license or a letter of approval from the municipality, or documentation clarifying the type of land use intended for ownership issued by an official authority, in addition to a copy of the title deed to be owned).

This service is intended for investment entities registered with the Ministry of Investment that wish to obtain a decision to approve the ownership of the property necessary for them to carry out their registered economic activities outside the geographical scope for the purpose of “housing workers, conducting activities.” This service takes only 5 working days, and the purpose of ownership must align with the registered economic activity of the entity.

Regarding the registration of entities for investment in Saudi Arabia according to the Investment System and its executive regulations, the guide added a requirement for (a copy of the commercial registration of the foreign partner certified by the Saudi embassy, along with a copy of the parent company’s registration if the nationality of the parent company differs from that of the applying company).

The ministry kept the rest of the previous requirements unchanged, which include (a copy of the commercial registration of the participating foreign entity certified by the Saudi embassy, a copy of the ID if one of the partners is a Gulf individual “whose data is not registered in the Absher system,” and the financial statements for the last financial year of the foreign company certified by the Saudi embassy), with an exemption for holders of the premium residency from the requirements.
