أصدرت محكمة التمييز بالبحرين حكماً نهائياً بإدانة شاعرة بتهمة الإزعاج المتعمَّد والإساءة إلى المطربة هند البحرينية عبر تطبيق «سناب شات»،إذ استغلّت المدانة حسابها لنشر سلسلة من الإهانات والتجريح، ورغم عدم التصريح باسم الفنانة في المنشورات، استندت المحكمة إلى القرائن وسياق الخلاف المهني السابق بين الطرفين لإثبات التهمة.
تفاصيل النزاع
بدأت الأزمة إثر خلاف أعقب علاقة عمل جمعت الشاعرة والفنانة هند البحرينية، ثم تطور الخلاف إلى هجوم متسلسل عبر منصة «سناب شات»، ما دفع النيابة العامة لتوجيه تهمة إساءة استعمال أجهزة التواصل السلكية واللاسلكية.
ورغم حصول الشاعرة على حكم بالبراءة في محكمة أول درجة، أستأنفت النيابة العامة على القرار، ما أدى لإصدار حكم من المحكمة الكبرى الجنائية الاستئنافية بإلغاء البراءة وفرض عقوبة الحبس، قبل أن تتدخل محكمة التمييز لتأكيد الإدانة مع استبدال عقوبة الحبس لـ 6 أشهر، بتعهد رسمي يمنع التعرض للفنانة بأي شكل.
تشهير إلكتروني
أرست المحكمة في حيثياتها مبدأً قانونياً بالغ الأهمية في قضايا التشهير الإلكتروني، فقد أكدت أن لها الصلاحية الكاملة لتحديد هوية المجني عليه من خلال ظروف الواقعة.
ويعني هذا أن لجوء المسيء إلى التلميح بدلاً من التصريح لا يعفيه من المساءلة القانونية، فمتى ما كانت الملابسات تشير بوضوح إلى الشخص المستهدف، تصبح الإدانة نافذة ولا تقبل الجدل أمام محكمة التمييز.
The Court of Cassation in Bahrain issued a final ruling convicting a poetess of the charges of intentional harassment and defamation against the singer Hind Al-Bahraini via the “Snapchat” application. The convicted individual exploited her account to publish a series of insults and slurs. Although the artist’s name was not explicitly mentioned in the posts, the court relied on circumstantial evidence and the context of the previous professional dispute between the two parties to establish the charges.
Details of the Dispute
The crisis began following a disagreement that followed a working relationship between the poetess and the artist Hind Al-Bahraini, which then escalated into a series of attacks via the “Snapchat” platform, prompting the public prosecution to file charges of misuse of communication devices.
Despite the poetess receiving a verdict of acquittal in the first instance court, the public prosecution appealed the decision, leading to a ruling from the higher criminal court of appeal to overturn the acquittal and impose a prison sentence. The Court of Cassation then intervened to confirm the conviction, substituting the prison sentence with a 6-month term, accompanied by an official commitment to refrain from any form of harassment against the artist.
Online Defamation
The court established a highly significant legal principle in cases of online defamation, affirming that it has the full authority to identify the victim based on the circumstances of the incident.
This means that resorting to insinuation instead of explicit statements does not exempt the offender from legal accountability. As long as the circumstances clearly indicate the targeted individual, the conviction becomes valid and indisputable before the Court of Cassation.
