The “Qiwa” platform clarified that the transfer of ownership of an establishment that does not have a commercial registration to another person is done through the licensing authority, and then the data of the ownership transfer is reflected on the platform after completing the procedure.
The platform indicated that the procedure is carried out through the Ministry of Commerce if the establishment has a commercial registration, or through the licensing authority if it operates under a license, so that the data is then reflected on “Qiwa”.
Regarding the rights of workers upon the transfer of ownership, Article 18 of the Labor Law stipulates that employment contracts remain valid and the service of the worker continues to be counted when the establishment is transferred to a new owner, or when there is a change in its legal form through merger, division, or otherwise.
The law holds both the previous and new owners jointly responsible for the rights of workers arising from the period prior to the transfer of ownership, including wages and the end-of-service benefits that are presumed due on the date of the transfer of ownership, among other rights.
In the case of the transfer of ownership of individual establishments, the law allows the previous and new owners to agree on the transfer of all previous worker rights to the new owner, with the written consent of the worker, while the worker has the right, if he does not agree, to request the termination of his contract and to receive his dues from the previous owner.
