أيدت المحكمة الاقتصادية في الإسكندرية حكم حبس مغني الراب المصري مروان بابلو لمدة عام مع الشغل، بعد إدانته في القضية المتهم فيها بالتعدي على القيم الأسرية والمجتمعية ونشر محتوى تضمن عبارات وألفاظًا اعتبرتها المحكمة خادشة للحياء العام، وذلك برفض الاستئناف المقدم على الحكم الصادر بحقه.
وجاء قرار المحكمة ليؤكد الحكم الصادر في وقت سابق، الذي تضمن كذلك تغريم مروان بابلو مبلغ 100 ألف جنيه، على خلفية اتهامه ببث ونشر مقاطع فيديو وأغانٍ عبر حساباته الرسمية على منصات التواصل الاجتماعي، احتوت –بحسب أوراق الدعوى– على ألفاظ وعبارات اعتُبرت مخالفة للقيم الأسرية والمجتمعية وتحرض على الفسق والفجور.
ورأت هيئة المحكمة أن نشر تلك العبارات يهدم الوقار ويزعزع الاحترام، وهو الأمر الذي تقضي معه المحكمة بمعاقبة المتهم عما اقترفه عملاً بنص المادة 25 من قانون مكافحة جرائم تنقية المعلومات رقم 175 لسنة 2018، والمادة 304/2 من قانون الإجراءات الجنائية، مع إلزامه بالمصاريف الجنائية بنص المادة 313 من قانون الإجراءات الجنائية، ولذلك أصدرت حكمها المتقدم.
وتعود وقائع القضية إلى بلاغ تقدم به أحد المحامين، اتهم فيه مغني الراب بتقديم أعمال غنائية تتضمن محتوى يخدش الحياء العام ويشكل تعديًا على القيم الأسرية، استناداً إلى استخدام الابتهال الديني الشهير للشيخ النقشبندي «مولاي إني ببابك» خلال حفلة بأسلوب اعتبره تجاوزاً بحق الموروث الديني والروحاني.
وطالب المحامي باتخاذ الإجراءات القانونية اللازمة بحقه، قبل أن تُحال القضية إلى المحكمة الاقتصادية المختصة في الإسكندرية.
وبدأت أزمة مروان بابلو في أكتوبر 2021، إذ قام مغني الراب الفلسطيني عدي عباس المعروف باسم «شب جديد» بتعديل كلمات الابتهال الديني «مولاي إني ببابك» إلى «مروان إني ببابك» خلال مشاركته في حفلة «بابلو».
وتصاعدت حدة الأزمة، ووصلت إلى حد إصدار نقابة المهن الموسيقية قرارها بمنع التعامل مع المؤدي مروان بابلو، وأبلغت بذلك كافة الجهات والهيئات والمتعهدين.
وأكدت النقابة أن القرار جاء بسبب تقديم «بابلو» في إحدى حفلاته ابتهالاً دينياً ثابتاً ويحمل معاني روحانية وقيماً سامية لدى المصريين، بطريقة تحمل استهانة بهذا الدعاء وبابتذال، وإفراغه من محتواه الأخلاقي، وجعله وكأنه عن ذات المؤدي، فضلاً عن تضمن الفيديو ألفاظاً خرجت عن كل الأخلاق والتقاليد الحميدة، وهو الأمر الذي أصاب المصريين بخيبة أمل.
وبعد نظر القضية، قضت المحكمة الاقتصادية بحبس مروان بابلو لمدة عام مع الشغل، إلى جانب توقيع غرامة مالية قدرها 100 ألف جنيه، وهو الحكم الذي جرى تأييده بعد نظر الاستئناف، ليصبح واجب النفاذ وفقًا للإجراءات القانونية المقررة، مع احتفاظ المتهم بحقه في سلوك طرق الطعن القانونية الأخرى إن كانت متاحة.
ويُعد مروان بابلو، واسمه الحقيقي مروان أحمد مطاوع، من أبرز مغني الراب في مصر، وحقق شهرة واسعة منذ عام 2019 عبر عدد من الأغاني التي تصدرت منصات الاستماع، قبل أن يعلن اعتزاله لفترة قصيرة ثم يعود إلى الساحة الفنية، ليواصل إصدار أعمال جديدة وإحياء حفلات داخل مصر وخارجها.
The Economic Court in Alexandria upheld the sentence of one year in prison with hard labor for Egyptian rapper Marwan Pablo, after he was convicted in a case accusing him of violating family and societal values and publishing content that included phrases and words deemed offensive to public morals, by rejecting the appeal submitted against the ruling issued against him.
The court’s decision confirmed the earlier ruling, which also included a fine of 100,000 Egyptian pounds for Marwan Pablo, following accusations of broadcasting and publishing video clips and songs through his official accounts on social media platforms, which contained – according to the case documents – words and phrases considered contrary to family and societal values and inciting debauchery and immorality.
The court found that publishing such phrases undermines dignity and disrupts respect, which led the court to punish the accused for his actions in accordance with Article 25 of the Anti-Information Technology Crimes Law No. 175 of 2018, and Article 304/2 of the Criminal Procedure Law, obliging him to pay the legal costs under Article 313 of the Criminal Procedure Law, thus issuing its aforementioned ruling.
The case dates back to a complaint filed by a lawyer, who accused the rapper of presenting musical works that included content offensive to public morals and constituted a violation of family values, based on the use of the famous religious supplication by Sheikh Al-Naqshbandi “Mawlay, I am at Your Door” during a concert in a manner considered a transgression against the religious and spiritual heritage.
The lawyer called for the necessary legal actions to be taken against him, before the case was referred to the competent Economic Court in Alexandria.
The crisis for Marwan Pablo began in October 2021, when Palestinian rapper Odi Abbas, known as “Shab Jadid,” altered the lyrics of the religious supplication “Mawlay, I am at Your Door” to “Marwan, I am at Your Door” during his participation in the “Pablo” concert.
The intensity of the crisis escalated, reaching the point where the Musicians’ Syndicate issued a decision to prohibit dealings with performer Marwan Pablo, informing all relevant authorities, bodies, and contractors.
The syndicate confirmed that the decision was made due to “Pablo” presenting a fixed religious supplication in one of his concerts that carries spiritual meanings and noble values among Egyptians, in a manner that belittles this supplication and trivializes it, stripping it of its moral content, and making it seem as if it were about the performer himself, in addition to the video containing words that went against all morals and good traditions, which disappointed Egyptians.
After reviewing the case, the Economic Court sentenced Marwan Pablo to one year in prison with hard labor, along with a financial fine of 100,000 Egyptian pounds, a ruling that was upheld after the appeal was considered, making it enforceable according to the established legal procedures, while the accused retains the right to pursue other legal avenues if available.
Marwan Pablo, whose real name is Marwan Ahmed Metwally, is one of the most prominent rappers in Egypt, achieving widespread fame since 2019 through a number of songs that topped listening platforms, before announcing a brief retirement and then returning to the artistic scene, continuing to release new works and performing concerts inside and outside Egypt.
